Am I allowed to wear headphones when I ride a bicycle?

According to Florida Statute 316.304 a bicyclist is not supposed to wear any type of head set or head phones that would prevent them from hearing any traffic or causing any other type of disturbance that would allow them to not be aware of what's going on in their surroundings. However, what's interesting is if a bicyclist is on a path such as a trail or any other bicycle path other than a road way, they are allowed to wear head phones because at time they are going to be considered pedestrians and they would have to abide by pedestrian law.
