Can a parent with a history of causing domestic violence get visitation with the children?

Yes. A parent with a history of causing domestic violence can get visitation with children. There are several things that the court looks at. It’s very rare for a parent to not be allowed to have any time with the children at all. The court looks at what type of violence was it, were the children involved in it or did they witness it, how old was it, how long ago did it happen, and what has been done to remedy it going forward such as counseling and that sort of thing. The court can order that the party have reduced time-sharing or no overnight time-sharing, or supervised time-sharing if need be. It’s very rare for the court to say that a parent cannot have any time with the children.
