Hiring an Attorney for a Contested Divorce

Posted by Michael G. Butash | Jan 24, 2020 | 0 Comments

There are two types of divorces that can happen depending on if two spouses agree to a divorce and their conditions. If individuals agree to a divorce, then it is called an uncontested divorce, and this is often the best option for people. Yet when two people cannot agree on the conditions of their divorce, it is called a contested divorce. While uncontested divorces may be able to be filed and finalized without legal representation, it is in the best interest of someone that is going through a contested divorce to hire a divorce attorney. Temple Terrace residents might not understand what issues need to be fought over when it comes to a divorce, and this can be a major issue for someone who chooses to go through the process alone.

Division of Property and Assets

One of the biggest issues with any divorce is how many times division of property and the assets of two individuals has to be given out fairly. This is easier when both parties agree to an uncontested divorce, but oftentimes in a contested divorce, many of the property and assets are also contested. This is why some people choose to hire a divorce attorney. Temple Terrace residents might want to ensure that something they own is theirs after the divorce, and a legal professional will try their best to make the separation as fair as possible, but this does not always go over well when two people have difference in opinions. Some concessions and deals may need to be in place in order for both sides to get what they want in terms of property and assets.

Court Trials

If concessions and settlements fail in a contested divorce, the issues and separation process still have to be resolved, in which it is then taken to court. When it comes to hiring a divorce attorney, Temple Terrace residents may want to consider representation in court. Not utilizing a legal professional for representation in a divorce case is the number one reason why they end up losing their trial and not getting what they wanted out of it. It is always a better idea to consider legal representation in any case than to go through the process alone.
