The determination as to who gets to keep the assets, such as your house, your car, your property, in a dissolution of marriage action, it's called equitable distribution or the fair distribution of the assets and the debts of the marriage. There is a multi-step process to determine what is a fair and equitable distribution. Some people think that an equitable distribution should be 50/50, and that's where the court starts out is a presumption that it's a 50/50 division of the assets and debts.
