How is annulment different from divorce?
In Florida, annulment is different from divorce legally, meaning that in a divorce the court is determining that a marriage has ended and now a couple are single. With an annulment, the court is determining that a marriage never existed. They go back to day one of the divorce, the day of the marriage, and they state that for a reason, may it be bigamy, or inability to consent, or fraud, that the marriage was invalid, and therefore the parties were never married. Practically speaking, the difference is at the end of an annulment there is no marriage, so you cannot get distribution of property, you cannot get alimony. You are just two single people trying to divide up your assets.
