Why Motorcycle Cases Require a Different Approach

Attorney Michael G. Butash, Butash Law Group

Insurance adjusters know that juries carry bias against motorcyclists. They use it. Whether the argument is that you were riding in a blind spot, that you were traveling too fast, or that the road conditions were a known risk, the goal is the same: reduce the payout by shifting blame onto you. These arguments get raised regardless of what the evidence actually shows.

We document motorcycle accident claims the way they need to be documented - accident reconstruction, witness statements, road and traffic data, and medical records that connect the crash directly to your injuries. On Pasco County roads like SR-54, US-98, and SR-52, where motorcycle accidents concentrate, we know the conditions, the common liability patterns, and what it takes to build a demand that reflects the full scope of what you’ve been through.

Recoverable damages in a serious motorcycle crash can include:

  • Emergency and ongoing medical treatment
  • Future care costs for permanent or long-term injuries
  • Lost wages and reduced earning capacity
  • Pain and suffering
  • Permanent disability or disfigurement

Serious crashes require serious numbers in the demand letter. We don’t undervalue claims because the math is uncomfortable.

Frequently Asked Questions

Florida does not require motorcyclists to carry insurance the way it requires car owners to carry PIP and property damage liability. However, if you are involved in a crash and are found at fault, you can be held personally liable for the other party's damages. Carrying liability and uninsured motorist coverage is strongly advisable, and uninsured motorist coverage becomes especially important given how many drivers on Florida roads carry minimum or no coverage.

Florida law allows riders 21 and older to ride without a helmet if they carry at least $10,000 in medical benefits coverage. Riders under 21 are required to wear a helmet. If you were not wearing a helmet at the time of your crash, the defense may argue that your head or facial injuries were worsened by that choice. This is a comparative fault argument, not an automatic bar to recovery - but it requires a deliberate response in how we build your case.

Yes. Florida follows a pure comparative negligence standard, which means your recovery is reduced by your percentage of fault - not eliminated. If a jury finds you 20% at fault for not wearing a helmet, you recover 80% of your damages. The insurance company will push this argument hard if it applies to your case, which is exactly why having an attorney who anticipates and addresses it from the start matters.

The most important difference is that Florida's no-fault PIP system does not apply to motorcycles. Car accident victims can access their own PIP coverage immediately for medical bills regardless of fault. Motorcycle riders have no equivalent fallback - you must pursue the at-fault driver's liability coverage directly, which means establishing fault clearly and quickly is central to your entire recovery strategy.

For crashes occurring on or after March 24, 2023, Florida's statute of limitations for personal injury claims is two years from the date of the accident. For crashes before that date, the prior four-year limit may apply. Missing the deadline typically means losing your right to recover, regardless of how strong your case is. If you were recently injured, the sooner you consult with an attorney, the better your options.
