What if I burped or regurgitated within twenty minutes prior to blowing?

If you burped or regurgitated within that time frame, it is possible for you to affect the breath test. The reason being is, the breath test is suppose to test what they call deep lung breath. If you burp or regurgitate, it’s going to affect that test. What is suppose to happen is, if you have burped or regurgitated within that time period, the machine is suppose say that you had a mouth alcohol error. If it doesn’t, that would be a problem. Its something for your attorney to look into. Hopefully, your breath test is video taped and we can show that you burped or regurgitated. Then, you can call an expert witness, if necessary, to challenge the validity of that breath test.
