The determination as to who gets to keep the assets, such as your house, your car, your property, in a dissolution of marriage action, it’s called equitable distribution or the fair distribution of the assets and the debts of the marriage. There is a multi-step process to determine what is a fair and equitable distribution. Some people think that an equitable distribution should be 50/50, and that’s where the court starts out is a presumption that it’s a 50/50 division of the assets and debts. However, there are arguments that can be made to convince the court that an equitable or fair distribution is not a 50/50 or equal distribution.

It’s important, when you meet with us for a divorce in Ridge Manor or anywhere in the Tampa Bay area, is we determine firstly, What are the most important assets to you? and those are ones we fight for the most, and then anything else we can get is just a bonus.
